Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall. All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

This website is owned and operated by The bKYND Company. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors the ability to create a personal account through which they can purchase and schedule services. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

Section II

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment

You agree to indemnify and hold The bKYND Company harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

Cancellation Policy

Section I

Please cancel reservations up to two hours of a class's starting time so that someone else can experience the great workout you'll be missing. If you fail to cancel a reservation and/or don't make it to class, we will charge a $10.00 "no show/late cancellation" fee. If there should be a sudden emergency within the two hour window, please contact us directly at support@thebkyndco.com.

Please keep in mind the following:

If you do not have a credit card on your account and/or if it is declined, your account will show a negative balance and you will be required to balance this out upon your next visit.
If you are ill and unable to attend your scheduled class, please let us know immediately to avoid the cancellation fee being charged. You will not be able to attend classes for 72-hours post notification/late-cancel.
Pay per session/Drop In/Group Packages (not unlimited) not canceled before the 2-hour window or client no-show will result in a forfeit of the reserved class; losing the session/class.

Section II

In the case of inclement weather or other extenuating circumstances, The bKYND Company may cancel services up to 24 hours in advance and return credits to the accounts of members who have purchased packages. This will be communicated directly to members who have scheduled services in advance and will additionally be posted on social networks for the general public.

The safety of members and employees is of top priority when making the decision to cancel services.

Refund and Return Policy

Section I

Merchandise categorized as apparel is eligible for free returns within the first 15 days of your purchase; if 15 days have passed since your purchase, you will not be offered a refund and/or exchange of any kind.

Eligibility for Refunds and Exchanges

Your item must be unused and in the same condition that you received it.
The item must have tags attached
To complete your return, we require a receipt or proof of purchase.
Only regular priced items may be refunded, sale items cannot be refunded.
If the item in question was marked as a gift when purchased and shipped directly to you, you will receive a gift credit for the value of your return.

Section II

Merchandise that is not categorized as apparel (water bottles, mugs, backpacks, etc.) is not eligible for return, refund, or exchange. The bKYND Company will not accept returns for any reason other than verified defect. If your product is defected, please contact us at support@thebkyndco.com.

Section III

Services that are paid for individually can be refunded, as long as they remain unused, up to thirty days after the date of purchase. No refunds will be provided beyond this date, or for services that have been redeemed. Refunds do not apply to late-cancellations or no-shows.

Each member can request a maximum of two refunds per months
